HOUSE OF REPRESENTATIVES AMENDMENTS TO S.B. 1435

(Reference to Senate engrossed bill)

 

 


Strike everything after the enacting clause and insert:

"Section 1.  Title 26, chapter 1, article 1, Arizona Revised Statutes, is amended by adding section 26-105, to read:

START_STATUTE26-105.  Emergency interoperability communication system; fund use

A.  The department of emergency and military affairs may establish an emergency interoperability communication system.  The department may use monies from the Arizona school safety fund established by section 41‑175 for the system.  The emergency interoperability communication system must have the ability to do all of the following:

1.  Maintain a secure, multimedia communication system for a user base that consists of public or private emergency entities, including hospitals, county and local law enforcement agencies, fire and rescue agencies and other public or private entities that the department determines are necessary.

2.  Provide a communication solution environment that allows for:

(a)  Identifying a system user's identity, location and operational status during an incident.

(b)  secure text messaging and file sharing for all users involved in an incident.

(c)  Secure sharing of maps, building floor plans and images among PARTICIPATING users and entities.

(d)  Integrating a manually activated panic alarm system that, when activated, establishes direct collaboration between participating entities.

(e)  Using multiple forms of real time COMMUNICATIONS and information collaboration, including voice and full motion video sharing during an incident.

3.  Be deployed to end users on an existing communication asset that is owned by the PARTICIPATING entity.

4.  Allow each participating entity to maintain discretionary, real time control of all communication assets that are owned and operated by the entity.

5.  Encrypt all media communications.

6.  Ensure the level of Privacy that is required by each participating entity.

B.  The department of emergency and military affairs must notify the state treasurer if the department does not establish an emergency interoperability communication system pursuant to this section to allow any monies remaining in the Arizona school safety fund established by section 41‑175 to be used for establishing a school safety system. END_STATUTE

Sec. 2.  Title 41, chapter 1, article 4, Arizona Revised Statutes, is amended by adding section 41-175, to read:

START_STATUTE41-175.  Arizona school safety fund; emergency interoperability communication systems; uses

A.  The Arizona school safety fund is established consisting of monies appropriated to the fund.  The state treasurer shall administer the fund.  The fund is subject to legislative appropriation.  The department of emergency and military affairs may use monies in the fund to establish an emergency interoperability communication system for use during the COVID‑19 pandemic or any other related pandemic, a wildfire occurring on state lands or any other emergency that involves the department of emergency and military affairs, the Arizona national guard or a public agency that can use an emergency interoperability communication system. 

B.  If the department of emergency and military affairs notifies the state treasurer that an emergency interoperability communication system will not be established pursuant to section 26‑105, the state treasurer may use monies in the fund for school safety programs or a school safety system.  END_STATUTE

Sec. 3.  Repeal; transfer of monies

A.  Section 41-1733, Arizona Revised Statutes, is repealed.

B.  All unexpended and unencumbered monies remaining in the public safety interoperability fund established by section 41‑1733, Arizona Revised Statutes, as repealed by subsection A of this section, are transferred to the Arizona school safety fund established by section 41‑175, Arizona Revised Statutes, as added by this act, on the effective date of this section."
